NOTICE OF SEIZURE OF PERSONAL PROPERTY Pursuant to O.C.G.A. §9-16-1 et. seq., any party claiming an interest in the following property is hereby notified that the following property was seized by the undersigned agency in Butts County, Georgia: SEVENTEEN THOUSAND EIGHT HUNDRED DOLLARS 00/100 IN U.S. CURRENCY. Conduct giving such rise to said seizure was as follows: on the 8th day of January, 2020, a vehicle driven by Cooper was stopped on I-75 for following to close and failure to maintain lane. Cooper was asked to exit the vehicle and the Deputy noticed an object in Cooper's front pocket. Cooper said it was money. The vehicle smelled of marijuana, and Cooper said he had been atound some earlier. A drug detection dog alerted on the vehicle. During the search, multiple cans of air fresheners were located. These are commonly used to mask the smell of drugs. A black bag containing several bundles of U.S. currencey was located on the rear seat. The bundles appeared packaged for use in drug transactions. The front seat passenger (Pertillo) said most was his and $2,000.00 was Ricks'. Pertillo did not know how much was in the bag but said it was less than $10,000.00. Another bag was found in the floorboard of the vehicle containing 2 bags of marijuana and a bundle of currency. Cooper said the bag was his, Pertillo said the money was withdrawn from the bank. Pertillo had a large bulge in his jacket which contained 2 more bundles of currency. Pertillo then stated he did not want to claim any of the currency, then Ricks and Cooper did the same. A disclaimer was signed by all parties. Claimants who may have an interest in said property are Dominique D. Cooper, Kenneth E. Pertillo and Jabrezah Y. Ricks.. Said property was used in violation of O.C.G.A. §9-16-1 et. seq., and 16-13-49 et. seq. in that the item(s) was/were used to facilitate the possession, sale, and distribution of controlled substances and/or marijuana and/or are proceeds derived or realized therefrom and that said item was used directly or indirectly used or intended for use in any manner to facilitate a violation of O.C.G.A Title 16, or of the laws of the United States or of any State relating to marijuana/controlled substance which is punishable by imprisonment of more than one year, and or said property was found in close proximity to controlled substances and/or marijuana. You are further notified that you may file a claim within thirty days of the second publication of this notice of seizure by sending a claim to the seizing law enforcement agency and to the District Attorney by certified mail, return receipt requested.
