NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT STATE OF GEORGIA COUNTY OF BUTTS BY VIRTUE OF THE POWER OF SALE contained in the Deed to Secure Debt given by Wayne K. English & Linda W. English to McIntosh State Bank, a Georgia Banking Corporation, dated June 10, 2002, and recorded June 24, 2002 in Deed Book 354, Page 116, Butts County Georgia records, said Deed to Secure Debt being given to secure a loan note dated June 10, 2002, in the original principal amount of $179,500.00, last modified at Deed Book 752, Page 224, transferred and assigned to Hamilton State Bank, a Georgia banking corporation and assignee of the Federal Deposit Insurance Corporation (FDIC) as Receiver for McIntosh State Bank (former bank), pursuant to that certain Purchase Assumption Agreement dated June 17, 2011, there will be sold at public outcry for cash to the highest bidder before the Courthouse door of Butts County, Georgia, between the legal hours of sale on the first Tuesday in August, 2020, by Ameris Bank successor by merger to Hamilton State Bank, as attorney-in-fact for Wayne K. English & Linda W. English, the following described property: All that tract or parcel of land, lying and being in Land Lot 13 of the 9th Land District of Butts County, Georgia contain 11.34 acres, more or less being more particularly described according to that certain survey prepared by Andy Williams dated 11/11/2001 for Wayne English and recorded in Plat Book 671, Page 356, Office of the Clerk, Butts County Superior Court. Said plat and all its descriptive data are incorporate herein by reference to same. Which currently has the address 305 Giles Ferry Road, Flovilla, GA 30216. The debt secured by said Deed to Secure Debt has been and is hereby declared due and payable because of non-payment of monthly installments on said loan note. Said property will be sold subject to the following encumbrances. (1)Outstanding ad valorem taxes and/or assessments, if any, and all prior encumbrances of record. To the best of the undersigned's knowledge and belief, the party/parties in possession of the property is/are Wayne & Linda English.
