NOTICE OF SALE UNDER POWER, BUTTS COUNTY Pursuant to the Power of Sale contained in a Security Deed given by Brianna D. Freeland to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Congressional Bank, its successors and assigns dated 1/26/2018 and recorded in Deed Book 850 Page 350 Butts County, Georgia records; as last transferred to or acquired by PENNYMAC LOAN SERVICES, LLC, conveying the after-described property to secure a Note in the original principal amount of $117,012.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Butts County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on April 6, 2021 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: All that tract or parcel of land lying and being in Land Lot 144 of the 1st District of Butts County, Georgia, being known as Lot 21, Country Meadows Subdivision, as per revised plat of same prepared by Moore Bass Consulting, as revised on 1/31/01, and being more particularly described as follows: To find the point of beginning, begin at an iron pin on the east right of way line of England Chapel Road (80' R/W) at its intersection with the north right of way line of Country Meadows Way (50' R/W); run thence along the north right of way line of County Meadows Way an arc distance of 38.90 feet with a chord of 35.10 feet bearing south 44 degrees 15 minutes 40 seconds east to an iron pin; thence continuing along said right of way line south 88 degrees 50 minutes 34 seconds east 1587.02 feet to an iron pin; thence an arc distance of 39.27 feet with a chord of 35.36 feet bearing north 46 degrees 09 minutes 26 seconds east to an iron pin on the west right-of-way line of Country Meadows Circle (50' R/W); run thence along said right of way line north 1 degree 49 minutes 66 seconds west 298.44 feet to an iron pin; thence continuing along said right of way line of Country Meadows Circle around a cul-de-sac the following courses and distances: A chord bearing north 22 degrees 56 minutes 15 seconds west 20.41 feet and arc distance of 21.03 feet to an iron pin; a chord bearing north 02 degrees 08 minutes 00 seconds east 75.66 feet and arc distance of 85.81 feet to an iron pin; a chord bearing north 88 degrees 10 minutes 08 seconds east 60.00 feet and arc distance of 64.35 feet to an iron pin and the point of beginning; from said point of beginning continue along the right of way of Country Meadows Circle an arc distance of 64.35 feet with chord bearing south 18 degrees 05 minutes 29 seconds east 60.00 feet to an iron pin; thence leaving the right of way line of Country Meadows Circle and running north 58 degrees 43 minutes 46 seconds east 249.87 feet to an iron pin; run thence north 00 degrees 00 minutes 35 seconds west 176.72 feet to a 3/8" rebar; run thence south 89 degrees 26 minutes 39 seconds west 136.44 feet to an iron pin; run thence south 21 degrees 06 minutes 54 seconds west 265.92 feet to an iron pin and the point of beginning. This conveyance is made subject to all zoning ordinances, easements and restrictions of record affecting said described property. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property is commonly known as 226 Country Meadows Cir., Jenkinsburg, GA 30234-2454 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Brianna D. Freeland or tenant or tenants. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
