Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by TREVOR E MARTIN to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. (''MERS'') AS NOMINEE FOR STATE BANK AND TRUST COMPANY, ITS SUCCESSORS AND ASSIGNS, dated 08/18/2017, and Recorded on 08/22/2017 as Book No. 839 and Page No. 72, BUTTS County, Georgia records, as last assigned to PENNYMAC LOAN SERVICES, LLC (the Secured Creditor), by assignment, conveying the afterdescribed property to secure a Note of even date in the original principal amount of $111,111.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the BUTTS County Courthouse within the legal hours of sale on the first Tuesday in March, 2020, the following described property: ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN LAND LOT 174 OF THE 3RD LAND DISTRICT OF BUTTS COUNTY, GEORGIA, AND BEING MORE PARTICULARLY SHOWN AND DESIGNATED AS TRACT 1 CONTAINING 6.13 ACRES, ACCORDING TO THAT CERTAIN PLAT OF SURVEY ENTITLED "SURVEY FOR JEFF R. KUHN", DATED SEPTEMBER 13, 1985, PREPARED BY W. R. FRANKS, GEORGIA REGISTERED LAND SURVEYOR NO. 871, AND RECORDED IN PLAT BOOK 9, PAGE 80, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF BUTTS COUNTY, GEORGIA; SAID PLAT IS BY THIS REFERENCE INCORPORATED HEREIN AND MADE A PART OF THIS DESCRIPTION FOR ALL PURPOSES. CROWN, DATED FEBRUARY 15, 1986, AND RECORDED IN DEED BOOK 99, PAGE 432, CLERK'S OFFICE, BUTTS COUNTY, GEORGIA; AND THAT CERTAIN QUITCLAIM DEED FROM DAVID T. CROWN TO JANET A. CROWN, DATED JANUARY 24, 1991, AND RECORDED IN DEED BOOK 137, PAGE 209, AFORESAID RECORDS; AND THAT CERTAIN JOINT TENANCY WITH SURVIVORSHIP WARRANTY DEED FROM JANET A. CROWN TO JANET A. CROWN AND DAVID T. CROWN, DATED DECEMBER 15, 2015, AND RECORDED IN DEED BOOK 793, PAGE 77, AFORESAID RECORDS. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
